These Terms of Service (“Terms”) govern your access to and use of the website kialagreens.com and all products offered by FOODSTATE, INC. (EIN 02-0436846), operating under the brand name FOODSTATE INC (“we,” “us,” or “our”). By accessing our website you agree to be bound by these Terms.

1. When these terms bind you

You are bound by these terms and by our Privacy Policy from the point you use this website, submit an order, or consent to receive messages from us. Should you disagree with them, do not do any of those three things.

2. Minimum age

Nothing here is sold to anybody under 18, and nobody under 18 can be added to the text programme. Placing an order is a statement that you are over that age and can enter into a binding agreement.

3. What we sell, and what it is not

Everything on this site, Crop Line included, is a dietary supplement rather than a medicine. None of it is intended to diagnose, treat, cure, or prevent any disease or medical condition, and we will not describe it as though it were. These statements have not been evaluated by the Food and Drug Administration (FDA). Responses differ between people and no outcome is promised. Speak to a qualified healthcare professional before you begin.

4. Consent to receive text messages

Where you give a mobile number and tick the consent box, you are agreeing under the Telephone Consumer Protection Act (TCPA) that FOODSTATE INC may send you recurring automated marketing and informational text messages at that number. What that commits each side to is set out below.

  • Consent is not a condition of purchase.
  • Frequency is not fixed and varies with promotions and activity.
  • Message and data rates may apply.
  • Reply STOP at any time to end the messages.
  • Reply HELP at any time to reach support.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

5. The guarantee

60 days from delivery to change your mind, opened or unopened, with no restocking charge and no explanation required. Contact hello@kialagreens.com to open it. Refunds return to the original payment method within 5 to 10 business days of the goods getting back to us.

6. Copyright and trade marks

Everything published here is owned by FOODSTATE, INC. or used under licence. You are welcome to read it, quote it fairly and link to it; you may not reproduce it wholesale, redistribute it or adapt it into another work without our prior written consent.

7. What we are and are not answerable for

FOODSTATE, INC. stands behind the products it sells and will put right what it gets wrong, up to the amount you paid for the product concerned. Beyond that, and to the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages.

8. Governing Law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law principles. Disputes shall be resolved exclusively in the courts located in the State of New Hampshire.

9. Revisions

This page is revised from time to time. The current version is always the one shown here, dated at the top, and using the site after a revision is published means accepting it.

11. Crop years, lots and withdrawals

  • Goods are agricultural. Crop years differ, and where a crop year tests differently from the last, the label says so rather than the difference being smoothed over.
  • Every unit carries a lot number tied to a log entry, a field and a set of release tests. FOODSTATE, INC. will supply all of it on request at no charge.
  • A batch that misses a release limit is quarantined and destroyed rather than reworked or blended into a passing batch.
  • When a line is out of stock it stays out until the next crop. We do not substitute and we do not take payment against a harvest that has not happened.
  • If a lot is withdrawn, we contact the people who received it from the lot record, refund in full, and do not require the goods back first.
  • Whatever rights your own state gives you survive everything written here. Where the two differ, whichever is better for you applies.
